Terms of Use - Wilson Voyages Travel Advisors, LLC

By using the services furnished by Wilson Voyages Travel Advisors, LLC (“WVTA”), you are signifying your agreement with the following terms and conditions, on behalf of yourself and all members of your traveling party (collectively, “You”). You warrant that you area a U.S. Resident, at least 18 years of age, and possess the legal authority to enter into this Agreement and to make travel bookings with WVTA. You agree to be financially responsible for all travel bookings you make with WVTA, whether made on behalf of yourself or for other members of your traveling party. You warrant that all information supplied by you on behalf of yourself, members of your household, or others for whom you are authorized to transact business with WVTA is true, accurate, and complete. You agree that you will only make legitimate reservations or purchases with WVTA and its Suppliers (defined herein), and you acknowledge that any fraudulent reservation or reservation further described in Section 10 herein is prohibited.

 

1.  Suppliers. WVTA acts as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, or other service provider named in your itinerary or confirmation (“Suppliers”).  WVTA is not responsible for the acts or omissions of the Suppliers or their failure to adhere to their own schedules, provide services or refunds, a Supplier's financial default, or failure to honor future trip credits. You acknowledge that your travel plans may be interrupted or cancelled by the Supplier, a government entity, or other third party over which WVTA has no control. You further acknowledge that the Supplier's own cancellation, rebooking and refund policies, subject to any applicable law that is now or may later be in effect, will govern your rights and remedies, including your right to receive a refund. Separate Supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select, and you understand and agree that by booking travel through WVTA, you are also agreeing to the booking terms of each Supplier partner you have selected for your itinerary. You agree that you will abide by the terms and conditions of purchase imposed by any Supplier that you have selected as a service provider on an itinerary you have approved.

 

2.  Review Documents. You agree to check your documents when you receive them.  You agree to review your itinerary and other travel documents for accuracy and to inform us promptly of any issues. The names on your documents must match your government-issued ID.  You agree to immediately contact WVTA in the event of an error or omission. 

 

3. Travel Booked Outside of WVTA. WVTA is not liable or responsible for any arrangements made independently of WVTA including, without limitation, airline, hotel, excursion, and travel protection related charges; any loss suffered from a cancellation or change. Hotel and airline rewards or loyalty points cannot be redeemed for travel arrangements made by WVTA.

 

4. Payments, Cancellations, Changes. All payments for travel are due prior to departure according to each Supplier’s terms and conditions of booking.  You understand that failure to make final payment or any violation of a Supplier’s conditions of purchase may result in cancellation of your reservations, in your being denied access to any flights, tours, hotels, cruises, or other travel services, or in your forfeiting any monies paid for your reservations. In certain instances, bookings may be non-refundable. You may not be entitled to a refund if you change or cancel your travel plans after confirmation of a booking. All cancellation requests must be sent to WVTA in writing. As a result of cancellation or changes to confirmed bookings, third-party Supplier’s cancellation penalties will apply and are not the responsibility of WVTA. Cancellation fees will be charged to the credit card or other payment method you authorized to pay for travel services or deducted from the Supplier’s refund.

 

You acknowledge and agree to be responsible for and to assume any fees and taxes arising out of your bookings through WVTA. By submitting a credit card authorization form to WVTA, you agree to allow WVTA to use your payment method to purchase travel products from our Suppliers on your behalf. Except in cases of fraud, you agree not to file any dispute with any bank, credit card company, or other financial institution to avoid paying for or violating any booking terms with any Supplier or WVTA. For the avoidance of doubt, this includes but is not limited to cancellations, changes in itinerary, or arrangements beyond reasonable control of WVTA the Suppliers. IF YOU ATTEMPT TO CHARGEBACK, REVERSE OR OTHERWISE COLLECT A PREVIOUSLY AUTHORIZED TRIP PAYMENT, WVTA RESERVES THE RIGHT TO COLLECT ALL ADDITIONAL COSTS, FEES AND EXPENSES ASSOCIATED WITH SUCH CHARGEBACK, REVERSAL OR COLLECTION, INCLUDING, WITHOUT LIMITATION, ATTORNEY FEES.

 

5. Right to Correct Errors; Offers Subject to Availability. WVTA reserves the right to correct errors. In the event of any pricing error or omission, WVTA reserves the right to adjust such pricing or make any other corrections. All offers, incentives and Supplier promotions are subject to availability and may change without notice. 

 

6. Assumption of Risk. WVTA assumes no responsibility for and shall not be liable for the acts or omissions on the part of any other party not under our control or any acts of God, unsafe conditions, terrorism, health hazards including pandemics, illness, weather hazards, or the suitability for a disabled person of any portion of any trip. WVTA has no special knowledge of dangers during travel or at destinations. It is your own decision to travel, and you are doing so with full knowledge of current travel recommendations and travel restrictions with regards to the risks of all diseases and any vaccination requirements, including, without limitation, COVID-19. You acknowledge and agree it is your responsibility to understand and abide by all requirements and restrictions when traveling. This may include the following: health affidavit forms; health screenings prior to departure and/or upon arrival; temperature screenings prior to departure and/or upon arrival; travel reason affidavit forms; online travel authorizations; airline safety & health requirements, such as health forms, screenings, face coverings; in-country requirements, such as periodic temperature checks, quarantine, face coverings; visas. Failure to meet the requirements and/or restrictions puts you at risk for fines, quarantine or deportation at your expense. EACH JURISDICTION TO WHICH YOU MAY TRAVEL HAS ITS OWN RULES, REGULATIONS, AND LAWS. YOU AGREE TO HOLD WVTA HARMLESS FOR ANY VIOLATION OR ALLEGED VIOLATION OF THOSE LAWS WHILE YOU ARE IN SUCH JURISDICTION, including, without limitation, use of or possession of drugs. You acknowledge and agree that activities included as part of itineraries may pose inherent risks and be dangerous. Your itinerary may also involve travel to remote areas without access to medical facilities or treatment, changing weather conditions, interactions or encounters with wildlife, and other potentially dangerous conditions. By booking a trip with WVTA, you acknowledge that you are aware that the physical exertion required to participate in certain activities can activate or aggravate pre-existing injuries, conditions, or congenital defects. You acknowledge that you should seek medical advice if you know or suspect that your physical condition may be incompatible with the activities on your itinerary. You may be required to wear approved safety equipment while participating in certain activities, and by booking travel with us and participating in these activities, you agree to use the recommended safety equipment and to ask questions if you are unsure about how to properly or safely use equipment, and hold WVTA harmless for any injuries or potential injuries suffered. 

 

7. Proof of Identity, Passports, and Visas.

 

Proof of Identification. All passengers must present accepted photo identification such as a passport or other state or government-issued photo identification. To avoid disruption to travel plans, air travelers are strongly encouraged to consult with the United States Department of Homeland Security to determine whether their state-issued identification is compliant and, if not, what alternate forms of identification will be accepted for travel.

 

Passports and Visas. With very limited exceptions, you must have a passport to travel to another country. International destinations may have additional requirements such as a visa that you must obtain prior to departure. If you are a non­-US citizen, different immigration requirements apply. You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination and your connecting points, and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination. Many countries require your passport to be valid for six months or more after your date of entry. Some countries will not admit persons convicted of a crime. Some countries require both parents’ consent for minors to travel. You are responsible for contacting the applicable consulate(s) as needed. 

 

8.   Price Increases. Travel arrangements involving airline and cruise components are subject to Suppliers’ supplemental price increases that may be imposed by the Supplier and/or government, even after you have completed your purchase. You hereby consent to any such price increases and authorize your credit or debit card to be used for them. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and you may be bound by those contracts regardless of whether you receive notice of their terms. WVTA’s quotes and confirmations include all mandatory fees (such as hotel resort fees) that are communicated to our reservations systems. However, some Suppliers (such as airlines, car rental companies, hotels, and cruise lines) may have other mandatory fees that WVTA has not been made aware of. WVTA is not responsible for such undisclosed or additional fees.

 

9. Tour, Cruise and Package Prices. Tour, cruise and package prices are subject to change without notice due to currency fluctuations, tariff changes or increase in operational costs. In addition, group tours/packages are based on a minimum number of passengers traveling; if the number of passengers falls below the minimum required, a surcharge may be imposed on all passengers.

 

10. Reservation Rule Violations; Changes During Trip. You agree not to purchase a ticket or tickets containing flight segments that you will not be using, such as a "point-beyond", "hidden-city", or "back-to-back tickets". You further agree not to purchase a round-trip ticket that you plan to use only for one-way travel. You acknowledge that the airlines generally prohibit all such tickets, and therefore WVTA does not guarantee that the airline will honor your ticket or tickets. If you do not use one of the flights in your reservation, the airline will cancel your remaining itinerary, and it may confiscate any loyalty rewards or credits. You agree to indemnify WVTA against airline claims for the difference between the full fare of your actual itinerary and the value of the ticket or tickets that you purchased.

11. Overbooking. Airline flights may be overbooked. WVTA is not responsible for any fees incurred (including, without limitation, fare increases, fees, hotel fees, meals, etc.) as a result of the airline’s overbooking policies. A person denied boarding on a flight may be entitled to a compensatory payment. The rules for denied boarding compensation are available by the particular airline.

 

12. Travel Insurance. If you elect to purchase travel insurance, the terms of the policy will dictate whether, and to what extent, coverage for any financial loss may exist under the circumstances of a pandemic, pre-existing medical conditions, and other policy exclusions. Consult the insurance carriers directly for details. Trip insurance or waivers provided by the Supplier may not offer insolvency coverage. No representation or description of the insurance made by WVTA staff constitutes a binding assurance or promise about the insurance, and You are responsible for verifying the terms and conditions of such policy(ies). You agree to hold WVTA harmless for your election not to purchase travel insurance or for any denial of claim by travel insurer.

 

13. Claims Deadline; Exclusive Jurisdiction. You agree to present any claims against WVTA within thirty (30) days after your trip ends and to file suit within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year.  You agree that the courts in Tarrant County, Texas will be the exclusive jurisdiction for all claims brought by you or WVTA, and you hereby submit to the personal jurisdiction of those courts.

 

14. Limitation of Liability; Indemnity. WVTA ACTS AS AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS AND DOES NOT HAVE THE RIGHT TO CONTROL THE OPERATIONS OF SUCH INDEPENDENT OPERATORS AND SUPPLIERS, YOU AGREE THAT WVTA IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, WHICH MAY ARISE OUT OF THESE SERVICES. WVTA HEREBY DISCLAIMS ANY LIABILITY WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES IN CONNECTION WITH THE GOODS OR SERVICES PROVIDED BY ANY PRINCIPAL SUPPLIER BOOKING THROUGH WVTA, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY OR IRREGULARITY WHICH MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, WILLFUL ACTS, OMISSIONS OR OTHERWISE OF SUCH SUPPLIER, OR OF ANY SUPPLIER OR THEIR RESPECTIVE EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES, INCLUDING, WITHOUT LIMITATION, THEIR FAILURE TO DELIVER OR THEIR PARTIAL OR INADEQUATE DELIVERY OF SERVICES, THEIR CANCELLATlON AND REFUND POLICIES, FUEL INCREASES, BANKRUPTCY, OR CESSATION OF OPERATIONS AND OTHER MATTERS OUTSIDE OF EMCO’S CONTROL, AND YOU HEREBY EXONERATE WVTA FROM ANY LIABILITY WITH RESPECT TO THE SAME.

 

WVTA HAS SOLELY RECEIVED COMMISSION AND FEES FOR TRAVEL TRANSACTIONS AND CLIENT AGREES AND UNDERSTANDS THAT ANY RECOVERY FROM WVTA WILL BE LIMITED TO THE AMOUNT OF COMMISSION AND FEES ACTUALLY RECEIVED BY WVTA.
